It is a crime in Tennessee for a person to knowingly manufacture a controlled substance, deliver a controlled substance, sell a controlled substance, or possess a controlled substance with intent to manufacture, deliver or sell such controlled substance. The most prevalent drug related crimes can be found in Tenn. Code Ann. ยง 39-17-417.
There are 7 different schedules of controlled substances in Tennessee. The most commonly prosecuted are Schedule VI, which consists primarily of marijuana, and Schedule II, which consists of cocaine, crack cocaine, and methamphetamine, among others.
Each schedule has its own levels of punishment within Tennessee’s sentencing structure. Drug charges come with potential jail time and minimum mandatory fines (for instance, the minimum fine of being convicted of a C class felony possessing a Schedule II substance is $2,000). If you are accused of a drug offense within 1,000 feet of a school, day care or park, the level of your crime is enhanced one felony class, and you could be made to serve 100% of the eventual sentence.
